Machine-Readable AI Marking
Machine-Readable AI Marking explained
Article 50 has applied since August 2, 2026. Providers must address effective, interoperable, robust and reliable technical marking as far as technically feasible. The legislation includes exceptions for assistive standard editing and operations that do not substantially alter input data or its semantics. The specific application must be assessed separately.
Deployers face different duties: deepfakes must be disclosed, and AI-generated or manipulated text published to inform the public on matters of public interest is covered, with an exception for human review or editorial control and retained editorial responsibility. Disclosure is adapted for evidently artistic, creative, satirical or fictional works. This is not a blanket visible-label requirement for every AI-assisted asset.
C2PA and Content Credentials can carry signed assertions about creation and editing. They do not establish the truth of an image, rights in an asset or complete compliance with Article 50. Metadata can be separated during export and platform processing, so check the actually delivered version and supported recovery methods. Missing credentials prove neither AI use nor human origin.
Creative Engineering considers the entire production chain. Keep origin, tools, editing, review, export and publication traceable. Decide visible disclosure separately from technical marking. This explanation provides professional orientation and does not replace legal advice on a specific deployment.
Examples
Hypothetical application
A production team develops a synthetic visual. It documents tools and assesses legal classification and possible visible disclosure. After uploading, it also checks which technical provenance features remain verifiable in the delivered file.
Key Points
- Provider marking and deployer disclosure are separate duties.
- Article 50 includes specific exceptions and adapted rules.
- C2PA supports provenance, not a truth or compliance guarantee.
Practical application
Identify provider and deployer roles. Assess the specific outputs, required disclosure and technical marking. Check the published file after export, cropping and platform processing.
Useful measures
Verifiable publication
Check whether the agreed evidence and required notices remain present in the final version.
Traceable approval
Record the responsible person, reviewed version and unresolved questions.
Common mistakes
- Treating a visible badge as a replacement for every technical obligation.
- Calling all AI-assisted editing a deepfake.
- Relying on an export label without checking the published version.
Sources and context
- EU AI Act: Article 50
Legal basis for role-specific transparency duties and exceptions.
- European Commission: Transparency obligations

- C2PA: Explainer

Frequently Asked Questions about Machine-Readable AI Marking
Article 50 does not create a blanket visible-label requirement for all AI content. Provider marking and deployer disclosure have different triggers. Other laws, platform rules or contracts may also apply.
No. C2PA is technical infrastructure for provenance assertions. Legal classification and any required visible disclosure need separate assessment.
